Brazilian man indicted for illegal reentry into United States

A Brazilian man has been indicted by a federal grand jury in Boston for illegally reentering the United States after deportation.

Jose Antonio Moreira Martins Desouza, 39, faces one count of unlawful reentry of a deported alien and will appear in federal court in Boston at a later date.

Desouza was taken into federal custody following his arrest by police on May 22, 2023, and subsequent detention by Immigration and Customs Enforcement on June 26, 2024. He is scheduled to appear in federal court in Boston at an unspecified future date.

According to the charging documents, Desouza was deported from the United States on November 14, 2012. It is alleged that he illegally reentered the country sometime after this removal. Desouza was arrested on May 22, 2023, and detained thereafter.

The charge of unlawful reentry of a deported alien carries a potential sentence of up to 20 years in prison, three years of supervised release, and a fine of up to $250,000. Sentences are determined by a federal district court judge based on U.S. Sentencing Guidelines and statutes governing criminal case sentencing.

Acting United States Attorney Joshua S. Levy and Todd Lyons, Field Office Director for Boston's U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations announced the indictment today. Assistant U.S. Attorney Luke A. Goldworm from the Major Crimes Unit is prosecuting the case.

The details contained in the charging documents are allegations. The defendant is presumed innocent unless proven guilty beyond a reasonable doubt in a court of law.
