Dominican national charged with illegal US reentry post-deportation

A Dominican man has been indicted by a federal grand jury in Boston for illegally reentering the United States after deportation. Jose De La Rosa Rosario, 50, faces one count of unlawful reentry of a deported alien.

De La Rosa was taken into federal custody following his arrest by police on September 3, 2024, and subsequent detention by Immigration and Customs Enforcement on September 16, 2024. He is scheduled to appear in federal court in Boston at a later date.

According to the indictment, De La Rosa was deported from the United States on July 3, 2018. It is alleged that he illegally reentered the country without permission sometime after his removal in July 2018.

The charge of unlawful reentry of a deported alien carries a potential sentence of up to 20 years in prison, three years of supervised release, and a fine of up to $250,000. Sentences are determined by a federal district court judge based on U.S. Sentencing Guidelines and relevant statutes.

Acting United States Attorney Joshua S. Levy and Todd M. Lyons, Field Office Director in Boston for U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations announced the indictment today. Special Assistant U.S. Attorney James J. Nagelberg from the Major Crimes Unit is prosecuting the case.

It should be noted that the details within the charging documents are allegations at this stage. The defendant is presumed innocent until proven guilty beyond a reasonable doubt in court.
